Restrictions on Use of Materials

No material or information from this site and/or e-mail may be copied, reproduced, republished, uploaded, posted, transmitted or distributed except as authorized in these terms of use, expressly authorized on the information or materials themselves, or approved in writing by Korley INK.

Payment

Korley INK requires 50% advance deposit prior to any work commencing. We will start the actual design process after agreement from both sides and all necessary paperwork is completed, signed, and delivered to us. The remaining 50% of payment must be paid when the work is completed and upon client approval. If you have any questions, concerns or comments about your project, please contact us at any time.

Disclaimer of Liability

Korley INK shall not be held liable for any improper or incorrect usage of materials or information described and/or contained in this site and assumes no responsibility for user’s application of them. In no event shall Korley INK be liable for any direct, indirect, incidental, special, exemplary or consequential damages (including, but not limited to, procurement or substitute goods or services; loss of use, data, or profits; or business interruption) however caused and on any theory of liability, whether in contract, strict liability or tort (including negligence or otherwise) arising in any way out of the use of this site or materials and information herein, even if advised of the possibility of such damage. This disclaimer of liability applies to any damages or injury, including but not limited to those caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, negligence or under any other cause of action.

Ownership

All final artwork becomes property of the client, having royalty-free (subject to contract/negotiations) use of the product upon payment of all fees. Korley INK retains the right to display the artwork in their portfolio and advertising materials. All designs, concepts, slogans or other materials displayed to the client which are not selected by the client, remain the full property of Korley INK. However, clients may purchase the additional designs provided within the samples for an additional fee.

Project Duration

Client agrees to provide timely responses to Korley INK after notification of deliverables, such as sample completion. Client shall have 48 hours to respond to each set of design samples submitted to the client for review. If after 48 hours, the client has failed to respond, Korley INK will cease any further development of the project until future negotiations. Korley INK will have no further obligation to client, and client shall pay Korley INK all fees and expenses associated with work already performed by Korley INK.

Revision

No revision work which requires payment will be started without authorization from client. Any request made by the client after the initial preliminary product design samples have been made and displayed, and after the client selects a design concept among the preliminary initial design samples, that significantly alter the selected design, including, but not limited to, name change, type of business change, theme of business change, and specifically requested illustration change, will incur additional fee.

Refund Policy

A full refund less an administration fee of 25% will be made if client does not wish to proceed with the product design BEFORE the initial design samples are created.

The refund policy will also not take into effect if:

1 ) The reason does not relate to our design.
2 ) You do not provide any feedback within 14 days.
3 ) You have obtained the design from a 3rd party.
